TERMS AND CONDITIONS

  • Terms and Conditions
    • These terms (including the schedule to these terms and the Privacy Policy) (together the “Terms”) govern your access and use of the Platform. By accessing and/or using the Platform you agree to be bound by these Terms. This takes effect from the first time you access the Platform.
    • These Terms apply whether you are a visitor to the Platform or a registered user of the Platform (each a “User”). If you are using our Platform as a representative of an entity, you are also agreeing to these Terms on behalf of that entity.
    • If you do not accept these Terms, then you must not access or use the Platform.
    • These Terms may change or be updated from time to time. It is your responsibility to access and check these Terms whenever you access the Platform.  The latest version of these Terms will govern any future usage by you of the Platform.
  • How to contact us

  • Overview
    • The Platform is owned and operated by Nowsnapp NZ Limited, a company registered in New Zealand, trading as Nowsnapp. Our New Zealand Business Number is 9429046680396 and our registered office is at Cnr Seaview & Howell Rd, Paraparaumu Beach, 5032, New Zealand.
    • The Platform provides a marketplace that allows Users to offer, sell and buy Microservices.
    • As part of providing the Platform, we may need to provide you with certain communications, such as service announcements and administrative messages. If you wish to opt out from receiving such communications, which may affect your use of our Platform, please contact our customer service team at support@nowsnapp.com.
    • If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us.
  • The Platform
    • Nowsnapp provides a platform upon which Users can order, buy and sell Microservices. Nowsnapp takes no part in and has no responsibility for, or liability in respect of, any Deals or other transactions between Users, or any Mircroservices sold or acquired by any User.
    • Given Nowsnapp’s limited role as the provider of a platform upon which Users may undertake Deals between themselves, you acknowledge and agree that:
      • all transactions between Users via the Platform shall be undertaken by Users at their own risk;
      • Nowsnapp has no responsibility for, and no liability in respect of, the conduct of, or any representations made by, any Users;
      • Nowsnapp makes no warranties or representations in any way whatsoever in respect of any Microservice bought or sold via the Platform; and
      • any disputes relating to any Microservice or any Deal will be a matter for resolution between the relevant Users, and Nowsnapp’s only involvement in such disputes shall be as specified in clause 2(b) of these Terms.
    • Nowsnapp processes payment for Microservices on behalf of Acting Member However, Nowsnapp does not act as agent for any Users of the Platform.
    • Nowsnapp has no control over and does not guarantee the existence, quality, safety or legality of any Microservices offered or advertised on the Platform, the accuracy, completeness or truth of any content or listings posted by Users, the credit worthiness of any User, the ability of Acting Members to sell or Posting Members to buy, or that a particular Posting Member and Acting Member will complete a particular transaction.
    • We may (at our discretion but are not obliged to) check, audit or monitor the information contained in listings, comments and/or reviews posted by Users. We reserve the right to remove any content which we consider as offensive, harmful, deceptive, discriminative, defamatory or otherwise inappropriate or misleading, or content that we believe may be infringing rights of third parties. We do not endorse or support any views expressed by any Users on our Platform.
    • The Platform is solely for the performance and purchase of Microservices in New Zealand.
  • Registration
    • If you wish to undertake a Deal on the Platform, you must undertake the registration process on the Website or the App and become a registered User.
    • In registering for an account on our Platform, you must provide truthful, accurate and up-to-date information about yourself. You should choose a strong and secure password. You must keep your password secure and confidential.
    • You agree not to share your account credentials or give others access to your account. If and when we detect that an account is shared by multiple users, we may treat this as a security breach and suspend or terminate your account.
    • We have the right to disable any password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you are in breach of these Terms.
    • You are responsible for all actions or activities that happens by, through or under your account, unless you report misuse.
  • Deal process
    • A Posting Member may place an Order on the Platform in accordance with the relevant instructions on the Platform.
    • An Acting Member may then bid on the Order placed by a Posting Member .
    • When the Posting Member accepts a bid placed by an Acting Member on the Posting Member’s Order, a legally binding contract between the Posting Member and the relevant Acting Member will be formed, pursuant to which the Posting Member agrees to purchase the Microservices from the Acting Member and the Acting Member agrees to perform the Microservices from the Posting Member on (and in accordance with):
      • the terms of the relevant accepted Order;
      • the terms of the accepted bid;
      • the Microservice terms contained in the Schedule to these terms; and
      • the applicable Nowsnapp rules and policies in force from time to time (and available on the Platform),

(each a legally binding “Deal”).

  • You should read the full listing before committing to bid for, perform or procure any Microservice.
  • To the extent an Acting Member bids on an Order, we are not an auctioneer for the purposes of the Auctioneer Act 2013 or at all.
  • Nowsnapp Fees
    • In consideration for the provision of the Platform, Nowsnapp charges a fee (“Convenience Fee”) on each successful Microservice provided by an Acting Member to a Posting Member.
    • The Convenience Fee shall be paid by the Posting Member at a rate of 8% of the final price of the Microservice, with a minimum fee of NZD5.00.
    • The Convenience Fee shall not become payable to Nowsnapp until the Microservice is rendered by the Acting Member, which occurs within the Platform when both the Acting Member and Posting Member exchange evaluations of the interaction.
    • The Convenience Fee is included within the price of the Deal. The Posting Member is notified within the Platform the final amount to be received by the Acting Member.
  • Your use of the Platform
    • You agree:
      • That you will not use the Platform for unlawful or unauthorised purposes or assist or allow anyone else to do so;
      • That you will not, in connection with your use of the Platform:
        • violate any applicable law, statute, ordinance or regulation (including, but not limited to those governing import/export controlling, consumer protections, criminal law, antidiscrimination, fair trade practices or unfair competition);
        • take out a bounty or engage in hiring a hitman or related services;
        • access or attempt to access the accounts of other Users or to penetrate or attempt to penetrate any security measures;
        • cause nuisance, annoyance or inconvenience;
        • re-sell or attempt to benefit in a commercial fashion from any data, content or information available on the Platform;
        • probe, scan, or test the vulnerability of any system or network;
        • breach or otherwise circumvent any security or authentication measures or service use limits;
        • access, tamper with, or use non-public areas or parts of the Platform;
        • interfere with or disrupt any User, host, or network, for example by sending a virus, trojan, worm, logic bomb, or any other material that is malicious or technologically harmful, overloading, flooding, spamming, or mail-bombing any part of the Platform, or by scripting the creation of any content in such manner as to interfere with or create an undue burden on the Platform;
        • reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Platform or any related technology that is not open source;
        • access, search, or create accounts for the Platform by any means (automated or otherwise) other than our publicly supported interfaces (for example, “scraping” or creating accounts in bulk) or attempt to do so;
        • send unsolicited communications, promotions or advertisements, or spam;
        • forge any TCP/IP packet header or any part of the header information in any email;
        • send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
        • conduct surveys, contests, or pyramid schemes, or promote or advertise products or services without appropriate authorisation;
        • abuse referrals or promotions;
        • post, publish, upload, display, distribute, or share materials that are unlawful, inappropriate, profane, pornographic, obscene, indecent, libelous, defamatory, abusive, or knowingly false, and/or that infringe intellectual property rights; or
        • violate the letter or spirit of these Terms;
      • to comply with your legal (including any tax and regulatory obligations) in relation to any payment you receive from a Deal;
      • to refrain from doing anything that may have the effect of damaging the reputation or goodwill of the Platform or Nowsnapp;
      • to provide Nowsnapp with any information regarding your identity or any Deal or Microservice that Nowsnapp requests from time to time;
      • to treat other Users with respect, and not to cause damage to their property or engage in any unlawful, threatening, harassing, abusive behaviour or activity; and
      • to compensate and defend Nowsnapp fully against any loss, liability, costs, claims or legal proceedings suffered or incurred by Nowsnapp (or any of its personnel or representatives) as a result of your breach of these Terms or any Deal or any unlawful or negligent conduct by you in connection with the Platform or any Deal.
    • Use of the App
      • You may access the Platform via the App.
      • Nowsnapp reserves the right to modify or withdraw the App or charge for the App at any time.
      • You acknowledge that the terms of agreement with your respective mobile network provider (the “Mobile Provider”) will continue to apply when using the App. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the App or for any such third party charges as may arise. You accept responsibility for any such charges that arise.
      • If you are not the bill payer for the mobile telephone or handheld device being used to access the App, you will be assumed to have received permission from the bill payer for using the App.
      • In order to use the App, you must have a compatible mobile telephone or handheld device, Internet access, and the necessary minimum specifications, including a device that is running Android 5.0 or iOS 7 or later.
      • The version of the App software may need to be updated or upgraded from time to time to add support for new functions and services.
    • Google and Apple
      • Where you have downloaded the App from the Apple Store, you acknowledge and agree that:
        • your rights to install and use the App are subject to these Terms and the relevant terms in the Apple Store terms of service;
        • Apple is not responsible for the App in any way, including for any maintenance or support of the App;
        • to the maximum extent permitted by law, Apple has no warranty obligations with respect to the App;
        • We (and not Apple) are responsible for addressing any claims by you or a third party in connection with the App (including any claims by a third party that the App breaches that persons intellectual property rights); and
        • although these Terms are entered into between you and us, Apple, as a third party beneficiary under these Terms, will have the right to enforce these Terms against you.
      • Where you have downloaded the App from the Google Play Store, you acknowledge and agree that:
        • your rights to install and use the App and make any in-app purchases through the App are subject to these Terms and the relevant terms in the Google Play Store terms of service;
        • Google is not responsible for the App in any way, including any maintenance or support of the App;
        • we (and not Google) are responsible for addressing any claims by you or a third party in connection with the App (including any claims by a third party that the App breaches that persons intellectual property rights); and
        • although these Terms are entered into between you and us, Google, as a third party beneficiary under these Terms, will have the right to enforce these Terms against you.
      • You represent and warrant (including for the benefit of Apple and Google) that you are not, and will not, be located in any country that is the subject of a US Government embargo or that has been designated by the US Government as a “terrorist supporting” country and that you are not listed on any US Government list of prohibited or restricted parties
    • Availability of, and changes to, the Platform
      • We are constantly changing and improving our Platform and the Microservices which are provided by Users. We may from time to time change or discontinue any of the products or services we offer, or add or remove functionalities or features, and we may suspend or stop certain products, services, functionalities or features altogether. If we discontinue certain products, services, functionalities or features, we will give you advance notice where reasonably possible.
      • We may release products, services, functionalities or features that we are still testing and evaluating. We will label such services as “beta”, “preview”, “early access” or “trial” or any words or phrases with similar meanings. You understand that these beta services are not as reliable as other products or services we offer.
      • We try our best to ensure that the Platform is always available, but we do not guarantee that the operation of or access to our Platform will be uninterrupted or continuous. Our Platform may be interrupted for many reasons, including maintenance, repairs, upgrades, network or equipment failures.
      • You are responsible for configuring your information technology, devices, computer programmes and platform or system in order to access the Platform.
      • We may, at any time, restrict, suspend or terminate your account and your use of the Platform and the services we provide if we believe you are in breach of these Terms, the terms of any Deal, or are misusing the Platform or any services we provide.
    • Exclusion of warranties
      • Except to the extent we are unable to disclaim warranties or guarantees by virtue of the law, you acknowledge and agree that that:
        • we provide the Platform and any products or services we offer on an “as is” and “as available” basis, and your access to or use of our Platform is at your own risk;
        • we expressly disclaim all warranties and representations (for example, warranties of merchantability, fitness for a particular purpose, and non-infringement);
        • we are not responsible for any delay or disruption in our Platform or any defect, virus, bugs or errors; and
        • while we try to offer reliable information, we do not promise that any content or information provided on our Platform (by us or any User) will be accurate, complete, up to date or always available.
        • we are not responsible for the conduct of or any content or information submitted or posted by any User of the Platform (whether online or offline).
        • we are not responsible for examining or warranting any listings provided by any Users. If you are providing Microservices, it is your responsibility to review the content of your bids for accuracy.
      • We integrate with third-party software to provide a full suite of functionalities to our Users. We are not responsible for any issues or loss arising from the use of any third-party software. Your access and use of the third-party software is governed by the terms of service or user agreements of that software.
      • However, if you are using the Platform as a consumer, nothing in these Terms is intended to have the effect of limiting or reducing your rights against us under the Consumer Guarantees Act 1993 (“CGA”). As a consumer, you are entitled to certain guarantees under the CGA.  If we breach any of those guarantees, your rights of redress are set out in the CGA.
    • Your warranties to Nowsnapp
      • You represent and warrant to Nowsnapp that:
        • you are above 18 years old; and are able to legally enter into contractual agreements;
        • as an Acting Member you are legally eligible to enter into employment in New Zealand; and
        • if you are using the Platform on behalf of an entity, you have the necessary rights and authority to agree to these Terms on behalf of that entity.
      • Limitations of liability
        • Except to the extent Nowsnapp is unable to exclude liability at law:
          • Nowsnapp is not liable for direct, indirect, special, incidental, consequential, punitive or exemplary damages or any kind whatsoever, including any lost data, lost business, lost profits, injury, claim, liability or damage or failure of security resulting in any way from your access to or use of the Platform or any Deal, whether foreseeable or not. Termination of your contractual relationship with Nowsnapp will be the sole and exclusive remedy for any and all damages or injuries suffered by you; and
          • If Nowsnapp is determined liable to you for losses, our liability is limited to the amount of Convenience Fees paid to Nowsnapp in connection with the Deal to which the loss or liability relates.
        • You indemnify and hold Nowsnapp its subsidiaries, affiliates, partners, offices, employees and contractors harmless from any liabilities, claims, expenses or demands (including legal fees and costs) made by any third party (including any other User) due to or arising out of:
          • your use or misuse of the Platform;
          • any negligent, unlawful or willful act or omission by you;
          • the violation by you of these Terms, the terms of any Deal, or any applicable law, rule, policy or regulation.
        • We do not exclude or limit our liability to you where it would be illegal to do so. This includes any of our liability for fraud or making fraudulent misrepresentation in operating the Platform or providing the products or services we offer.
      • Your content and intellectual property
        • When providing content on or to our Platform, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use, reproduce, process, adapt, modify, publish, display and distribute such content for the purposes of providing the Microservices to you and the promotion of our Platform.
        • For all content that you provide, you warrant that:
          • the content is accurate, up to date and not misleading;
          • you own or otherwise control all necessary rights to meet your obligations under these Terms regarding such content; and
          • the use of such content does not and will not infringe any intellectual property rights of any third party.
        • We do not take any responsibility, nor do we assume any liability, for any content provided by you or any third party. You agree not to hold us liable for any inaccurate or misleading content.
        • If you believe your intellectual property rights have been infringed, please contact us by emailing us at support@nowsnapp.com or call our customer service team at +852 5997 8511.
      • Our content and intellectual property
        • All intellectual property rights subsisting in the Platform or the products or services we provide belong to us or our licensors. All rights under applicable laws are hereby reserved. You must not upload, post, publish, reproduce, transmit or distribute any content or component of our Platform in any way, or create any derivative works with respect to any such content or component.
        • Our name “Nowsnapp” and our marks and logos are our trade marks (be it registered or unregistered) and may not be used without our express prior written consent.
      • Use of your personal information
        • We collect personal information about Users when they access and/or use the Platform. This may include (without limitation) information such as registration details and profiling, particulars of use, regularity of access and the content viewed. You agree to allow Nowsnapp the right to use any personal information collected in the pursuit of Nowsnapp achieving its goals and to provide better information and services to Users.
        • The personal information you provide to us will be used (and disclosed) in the manner specified in our Privacy Policy, including for the purposes of:
          • your registration on the Platform;
          • to supply the Platform for use by you in the manner anticipated by these Terms;
          • to process payment in connection with any Deal you enter into;
          • as permitted by the Privacy Act 1993 and any other applicable privacy laws;
          • if you agreed to this during the Order process, to give you information about similar Microservices that are available on our Platform, but you may stop receiving this at any time by contacting us;
          • to protect the rights, property and safety of Nowsnapp or any User (or any of their employees or contractors); and
          • to comply with any applicable law, and any other purposes consented to by you from time to time.
        • We will only give your personal information to third parties in accordance with the Privacy Policy and where the law either requires or allows us to do so.
      • Feedback
        • We value and welcome feedback on our Platform. You agree that we are free to use, disclose, adopt and/or modify any feedback and any information (including any ideas, concepts, proposals, suggestions or comments) provided by you to use in connection with our Platform or any products or services we offer, without any payment to you.
        • You waive and agree to waive any rights to claim for any fees, royalties, charges or other payments in relation to our use, disclosure, adoption and/or modification of any of your feedback.
        • Users are able to report any content on the platform deemed offensive, or against these Terms of Use by using the Report functionality located within the mobile application itself, or by emailing us at support@nowsnapp.com.
      • Disputes

Disputes between Users

  • Nowsnapp encourages you to try and resolve disputes (including claims of refunds and/or returns) with other Users directly.
  • After the rendering of a Microservice, the Posting Member and/or the Acting Member may at any time, declare a dispute, in which case the following dispute process must be followed:
    • Both the Posting Member and Acting Member must first engage between themselves (in good faith) to resolve the dispute.
    • Nowsnapp will undertake the role of facilitator, taking reasonable efforts (within the limits of these Terms) to arrive at an amicable settlement between the Posting Member and Acting Member. However, Nowsnapp will never be a party to such a resolution as Nowsnapp operates solely as a marketplace platform.
  • Nowsnapp may, at any time, investigate received dispute claims, and reserves the right at any time to suspend or terminate the relevant Users’ access to and use of the Platform.

Disputes between Users and Nowsnapp

  • Any problems that occur whilst accessing or using the Platform or any complaints or questions you have in connection with the Platform must be notified to Nowsnapp in writing to the contact details in section 1 above, at your earliest opportunity.
  • You will not commence any court or arbitration proceedings relating to a question, difference or dispute relating to these Terms or the services provided by Nowsnapp via the Platform (a “Dispute”) unless you have first complied with this section.
  • Where any Dispute arises, you (or your representative) and Nowsnapp will meet and negotiate in good faith in an attempt to resolve the Dispute amicably by good faith discussion.
  • Where the representatives of the parties cannot resolve the Dispute within 10 working days (or as otherwise agreed) of initialing negotiations, the relevant parties agree to mediate any Dispute (in New Zealand) in terms of the Resolution Institute New Zealand Incorporated Standard Mediation Agreement. The mediation will be conducted by a mediator at a fee paid by the parties to the Dispute.
  • If the parties fail to settle the Dispute by mediation, then either party may initiate arbitration or court action in respect of the Dispute.
  • Nothing in this section will preclude a party from taking immediate steps to seek urgent injunctive or equitable relief before an appropriate court.
  • Termination
    • You may stop using the Platform at any time by deactivating your account.
    • We reserve the right to suspend or terminate your access to our Platform, if we reasonably believe:
      • you are in breach of these Terms or the terms of any Deal;
      • you are using the Platform in a manner that would cause a risk of harm or loss to us, other Users, or the public;
      • we are requested to do so by government or regulatory authorities or as required under applicable laws, regulations or legal processes; or
      • our provision of the Platform to you is no longer possible or commercially viable.

In any of the above cases, we will notify you by the email address associated with your account or at the next time you attempt to access your account, unless we are prohibited from notifying you by law.

  • Where we consider necessary or appropriate, we will report any breach of these Terms to law enforcement authorities and we will cooperate with such authorities by disclosing your identity and providing any information about you within our systems to them.
  • Other terms
    • We may transfer our rights and obligations under these Terms to another organisation. We will contact you to let you know if we plan to do this. If you do not wish to continue the contract with the transferee, you must notify us and immediately cease to use the Platform. To the extent any payments (for Microservices performed by you) are due at the date you end your contract with us, we will pay you such amounts.
    • You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.
    • If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    • Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breach of these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
    • These Terms constitute the entire agreement between any User and us in relation to the use of the Platform. These Terms supersede and extinguish all other agreements, promises, assurances, warranties, representations and understandings between any User and us, whether written or oral, in relation to the use of the Platform.
    • You acknowledge that you will have no remedies in respect of any statement, representation, assurance or warranty that is not set out in these Terms.
    • These Terms are governed by and shall be construed in accordance with the laws of New Zealand. The courts of New Zealand shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
  • Definitions
    • In these Terms, the following definitions apply unless otherwise defined or the context requires otherwise:
      • Apple” means Apple Inc and other companies within its group.
      • Apple Store” means the store/platform operated by Apple making the APP available to iOS devices.
      • Acting Member” means a User marking itself available to provide Microservices in response to Posting Members’ Orders in real-time on the Platform.
      • Posting Member” means a User publishing an Order for a Microservice on the Platform.
      • Google” means Google Inc and other companies within its group.
      • Google Play Store” means the store/platform operated by Google making the App available to devices.
      • Microservice” means a service that is procured or performed by Users of the Platform.
      • Nowsnapp” means Nowsnapp NZ Limited.
      • Order” or “Offer” means the request for a Microservice by the Posting Member, which is represented visually as a banknote on the Platform.
      • Platform” means, collectively, the Nowsnapp website, software, applications, application programming interfaces (APIs), our notifications and any information or content appearing therein provided by us.
      • Privacy Policy” means the Nowsnapp privacy policy found within the application (Settings), as updated by Nowsnapp from time to time.

SCHEDULE: MICROSERVICE TERMS

  • Right to cancel a Microservice
    • Any Order placed or bid submitted in respect of a Microservice is deemed irrevocable and unconditional. However, at any moment prior to execution of a Microservice, both the Posting Member and Acting Member may agree to cancel a Deal.
  • Right to make changes to a Microservice
    • If a Posting Member wishes to make a change to the Microservice, the Posting Member must contact the Acting Member. The Acting Member has full discretion whether or not to accept any requested changes and notify the Posting Member of any resulting changes to the price, timing of supply or any other changes to the Microservice. If the Acting Member cannot make the change or the consequences of making the change are unacceptable to the Posting Member, the Posting Member may end the Deal in accordance with clause 4 of these Terms.
    • Acting Members may make minor changes to the Microservices they provide from time to time in order to:
      • reflect changes in relevant laws and regulatory requirements; and/or
      • implement minor technical adjustments and improvements, for example to address a security threat.

These changes will not affect a Posting Member’s use of the Microservice.

  • If an Acting Member makes changes, other than a minor change, to their Microservices or their terms for Microservices (as specified in the Acting Member’s bid), the Acting Member will notify the Posting Member prior to the changes take effect. If the Posting Member does not accept the changes, the Posting Member may end the Deal in accordance with clause 4 of these Terms.
  • Defects in Microservices
    • If a Posting Member becomes aware of any defect in all or part of the Microservices performed:
      • the Posting Member must give notice in writing to the Acting Member; and
      • where the Microservices reported are found to be defective the Acting Member may, at its option, re-perform the Microservices; and
      • if the Acting Member does not re-perform the Microservices satisfactorily, the Posting Member may end the Deal and lodge a claim with Nowsnapp (with our Customer Happiness team at support@nowsnapp.com) for any refunds due for a refund of the price of such defective Microservices.
    • Ending a Deal
      • If a Posting Member wishes to end a Deal for a reason set out in clauses 2 or 3 of these Terms, or because there is a risk that supply of the Microservice may be significantly delayed because of events outside the Acting Member’s control, the Posting Member must notify the Acting Member and the Deal will end immediately. In this situation, the Posting Member may, without prejudicing any right or remedy available to the Posting Member at law, lodge a claim with our Customer Happiness team (at support@nowsnapp.com) for a full refund for any Microservices which have been paid for by the Posting Member, but not provided by the Acting Member at the date on which the Deal ended.
    • Price and payment for Microservices
      • Posting Members specify the price of the Microservice when placing an Order. Acting Members then bid for the Deal by counter-offering (or agreeing to) an acceptable price. The price and terms of payment of the Microservice will be the price and payment terms on which the Posting Member agrees to procure the Microservices from the chosen Acting Member.
      • Prices are in New Zealand Dollars (“NZD”), unless otherwise agreed between the Posting Member and Acting Member.
      • Prices are purely determined by the interaction between Acting Members and Posting Members. Nowsnapp is not involved in suggesting, fixing or determining prices, and acts solely as a marketplace platform.
      • Certain ancillary fees may also be payable by the Acting Member and/or the Posting Member. For example, Posting Members and Acting Members may be required to pay additional transaction fees depending on the selected payment method for the Microservice determined between themselves. These fees are outside of the Platform and are charged by the financial provider directly on the User’s credit card, Paypal, or Wechat account. These fees are charged directly to the User and are thus non-refundable from Nowsnapp.
